LEGAL FRAMEWORK · ITALY
Minority categories do not all have the same legal status in Italy
This page supports research and is not legal advice. It distinguishes Italian legal provisions, the Observatory’s descriptive categories and communities’ self-identification.
Constitutional principles
Articles 2 and 3 of the Italian Constitution concern inviolable rights, solidarity and equality.
Linguistic minorities
Article 6 protects linguistic minorities through specific provisions. Law no. 482 of 15 December 1999 concerns Italy’s historical linguistic minorities; it does not automatically extend to every ethnic, national or religious category.
Religious, national and ethnic minorities
Religious freedom is governed by distinct constitutional provisions. “National” and “ethnic” minority are used in international sources and research but do not automatically identify one legal status in Italy.
Editorial rule
The Observatory does not assign identity. Each dossier must distinguish legal terminology, analytical categories, declared self-identification and disputed terms. English translations are non-authoritative unless issued by the competent authority.
